A court ruled to abandon the Boston Marathon bomber’s capital punishment

  • The death penalty of Boston Marathon bomber Dzhokhar Tsarnaev has been vacated, a federal appeals court ruled on Friday.
  • The panel of the 1st US Circuit Court of Appeal said the judge “fell short” in evaluating jurors for potential bias and bought a retrial over the sentence for Tsarnaev’s crimes, Reuters reported.

A federal appeals court ruled to vacate the death sentence of Boston Marathon bomber Dzhokhar Tsarnaev on Friday, but said he will remain in prison for the rest of his life.

The panel of the first United States Circuit Court of Appeal said the judge “failed” in screening jurors for possible bias and stopped working to leave out jurors who had currently concluded that Tsarnaev was guilty after seeing news coverage of the battles and their aftermath, according to Reuters.

Composing for the court, US Circuit Judge O. Rogeriee Thompson stated the jurors had “already formed a viewpoint that Dzhokhar was guilty– and he did so in large part because they responded to ‘yes’ to the question whether they might choose this prominent case based upon the proof,” Reuters reported.

However, the court bought a retrial over the sentence for Tsarnaev’s criminal activities, where a brand-new set of jurors can once again decide if he should be sentenced to death.

In case this doesn’t occur, the three-judge panel said that the Kyrgyz-American national would still remain in federal prison for the rest of his life.

” And simply to be clear: Due to the fact that we are affirming the convictions and the many life sentences imposed on those staying counts (which Dzhokhar has actually not challenged), Dzhokhar will stay confined to jail for the rest of his life, with the only concern remaining being whether the federal government will end his life by executing him,” Thompson said, according to CNN.

Tsarnaev, who is now 27, will continue to be held at the ADX Florence supermax prison– the country’s most safe and secure federal jail in Florence, Colorado.

Tsarnaev and his older bro, Tamerlan, triggered a pair of homemade pressure-cooker bombs near the finish line of the Boston Marathon on April 15, 2013, eliminating three viewers and hurting more than 260 people.

His bro was killed in a shootout with police three days later while Tsarnaev was caught by authorities and convicted in 2015.
